However, the comparatively mature theory and practice for the registration protection of single color trademarks have been formed in foreign countries such as US and EU. The review of four theories which opposed to the protection registration of single color trademarks including the color depletion theory, the shade confusion theory, the color functionality theory and the non-recognition theory demonstrates single color trademarks can be registered. In order to obtain the registration protection, the single color trademark needs to gain distinctiveness through the use and should be devoid of utilitarian functionality and aesthetical functionality. In our country, the single color trademark has not gained registration protection for a long time.
